Fabrication: who makes the work, and who carries the risk if it fails

Fabrication of a commissioned public artwork happens under one of two contracting routes, and the choice decides who pays if the work fails: either the artist holds the fabrication contract and subcontracts the foundry, or the commissioner holds it directly and the artist supervises. Bronze sculpture commissions in the UK usually run the first way, because casting is inseparable from modelling. Large steel, glass or civil-scale works run the second. Neither is safer in the abstract; what matters is that the agreement states which is in force before anything is cut, cast or poured.
The two routes, and where the risk lands
The two routes put the same work in the same workshop and produce different obligations, because a different party is the fabricator’s client.

The worst arrangement is the undeclared hybrid, where the commissioner pays the fabricator directly as a convenience while everyone still treats the artist as responsible. When a weld cracks two years later, nobody can say who the fabricator’s client was. Write the route into the agreement, and where the commissioner pays a fabricator directly, name it as a nominated subcontractor with its obligations set out.
The approved design, and what signing it off commits you to
The approved design is the drawing set and specification the finished work is measured against, and signing it off is the most consequential act in a commission. Before that signature, changes are conversation. After it they are variations, and variations cost money because moulds have been made, steel ordered and a workshop slot booked.
A usable approved design contains six things: overall dimensions, materials and grades, finishes and colours given as a reference not a description, fixing and foundation details, weight and centre of gravity, and the tolerances the fabricator may work to. A pack that stops at a rendering gets interpreted the way that is cheapest to make.
Sign off in three stages: concept, developed design, and technical or production design. Each is a payment trigger and a chance to stop cheaply. The third is the stage commissioners skip and the one that saves the project, where the fabricator, the engineer and the artist agree the thing can be built as drawn.
Materials, and the consequences that come with them
Every material choice is also a maintenance, cost and lifespan decision. Cost tracks the material and the labour it demands, not the height of the finished piece.
- Cast bronze is the traditional choice for figurative work and the most durable, with a service life measured in centuries. Its cost follows the weight of metal, the number of moulds and the hours of chasing and patination, which is why a life-size figure is a five-figure fabrication cost before any artist fee. Clay modelling comes first, then mould-making, then casting, rarely under six months.
- Stainless steel suits large abstract forms and mirror or brushed finishes. It resists corrosion but shows every weld, so finishing labour is the cost, and grade matters near the coast.
- Weathering steel develops a stable oxide surface and needs no coating, but it stains the paving beneath it for the first few years.
- Stone is carved or machined, and its weight pushes cost into transport, lifting and foundations, but durability varies more inside the category than the word suggests. Granite is close to inert outdoors in the UK. Limestone and sandstone weather at rates that depend on the bed the block was cut from, the exposure and the detailing. Marble is calcite and dissolves slowly under acid deposition, so an exterior marble surface in a UK town loses fine detail over decades, which is why conservators treat outdoor marble as a maintenance liability rather than a permanent material.
- Cast concrete is cheap per unit volume and expensive per mould, so it suits a repeating form.
- Glass and resin bring light and colour and the shortest lifespan of the permanent materials, with a replacement plan written while the maker is still trading.
What a mural is, as a piece of fabrication
A mural is fabricated on the wall, the one form of public art with no factory stage and no chance to reject the work before installation. The sequence is fixed: survey the substrate, repair and prepare it, prime it, apply the artwork, then seal it with a protective or anti-graffiti coating.
Three things determine how long it lasts. The substrate has to be sound and dry, because paint over a damp or friable wall fails from behind. Exposure matters, since a south-facing wall fades pigments faster than a sheltered one. The coating matters most, because a sacrificial anti-graffiti layer can be cleaned and renewed while an uncoated mural cannot. On typical UK exposure a well-prepared and coated exterior mural holds up for five to fifteen years, and an uncoated one on a poor substrate can look tired within three.
That lifespan has to reach the client before the budget is set, because a mural is often chosen for being affordable and then expected to behave like a sculpture. It is affordable partly because it is temporary. Wall owner permission, access equipment and traffic management routinely cost more than allowed for.
The engineer, and what a structural check covers
A structural engineer is required on any freestanding permanent work of significant size, and the check is not a formality. The engineer calculates wind loading, sizes the foundation for the ground conditions on that site, specifies the fixings, and confirms the piece is stable if somebody climbs on it, because somebody will. Near a highway, a railway or a watercourse, other parties will want that calculation too.
Installing a permanent artwork with groundworks is generally construction work, which brings the Construction (Design and Management) Regulations 2015 into play in Great Britain. Those regulations place duties on the client, meaning the commissioner and not only the contractor. A commissioner who has never run construction should raise this with their estates team early, because the duties attach whether or not anyone realised they had them.
Sign-off, inspection and handover
Fabrication ends at handover, which has three components that should each condition the final payment. First, inspection at the workshop before transport, because a defect found on a workshop floor is cheap and the same defect on a plinth is not. Second, practical completion on site, recorded in writing with snags listed and dated. Third, the handover pack: the maintenance manual, material and finish specifications, fixing details, the engineer’s certification, and contacts for the fabricator.
The defects period then runs, commonly six or twelve months, during which the artist or fabricator remains obliged to remedy failures in workmanship or materials. Defects are not damage. A coating that lifts is a defect; a work hit by a vehicle is an insurance matter. Writing that distinction in advance stops the first winter becoming an argument about who pays.
